3-501.16(A)(2) Maintain TCS foods in cold holding at 41F or less. -P
Observed multiple TCS food items cold holding in the grab and go case temping above 41 degrees F.
EHS observed the ambient air temp at 40 degrees F.
PIC stated that these TCS food items were placed in here this morning (around 10:30AM), and she checked the temperature and it was reading in the mid-30's, but no temperature checks have been conducted afterwards throughout the shift, so it in unclear how long these TCS food items have been out of temp.
PIC contacted Store Manager of G-Mart, William, who visited on-site while EHS was still at the facility and William stated that he will put a work order in for the unit to be checked out.
PIC voluntarily discarded all TCS food items that were temping above 41 degrees F, and transferred the ones that were at the proper temps into a different cold holding unit.
VERIFICATION REQUIRED within 3 days to ensure the unit has been repaired.

Observed multiple TCS food items in the grab and go case that were labeled for sale past it's 7-day expiration: stir-fried fish cakes date-labeled "packed on 2/22, sell by 3/01," seasoned seaweed "packed on 2/22, sell by 3/01," seasoned sliced radish "packed on 2/21, sell by 2/28," seasoned soy sprouts "packed on 2/22, sell by 3/01."
CDI: PIC had food employee create new date labels so that the TCS food items were sold within the 7-day window.
Observed a deli container of cut cabbage in the deli fliptop without a date label. PIC stated that it was cut on the same day as the cut cabbage bag stored in one of the reach-in coolers. EHS observed that the cut cabbage bag in reference to this was date-marked 2/19.

#39 · Contamination prevented during food preparation, storage & display
Corrected during inspection
3-303.12(B)(C)(D) Unpackaged food may not be stored in direct contact with undrained ice except: whole raw fruits or vegetables; cut raw vegetables such as celery, carrots, or potatoes; tofu; and raw poultry and raw fish received immersed in ice.
Observed a metal pan of flat rice cakes, metal pan of cylindrical rice cakes, and a metal pan of re-hydrated potato starch noodles all submerged in water.
CDI: EHS explained to the PIC that although EHS understands that re-hydrating these food items in cold water before stir-frying or adding them into a soup makes these food items more glutinous and softer to eat in these Korean dishes, these food items are TCS food items, do not come received immersed in ice, and are not one of the food items listed in the code citation where it is exempt for it being in direct contact with undrained ice. EHS also explained that the water activity is the reasoning why these food items cannot be submerged and sitting in water even under refrigeration; PIC drained all of these food items since PIC stated that she added water to soak these food items this morning, around 10:30AM, and placed back into the cold holding unit.
#56 · Meets ventilation & lighting requirements; designated areas used
